If smoke in an apartment is cause health issues can i break my lease?

I live in a 3rd floor apartment. My wife recently became pregnant. Th e tentant below us is a smoker and the smoke from his apartment is coming up throught the heating vents. We feel this could be harmfull to the pregnancy. I understand he has a right to smoke so dont give me a smart *** answer. I am asking if I have the right to get out of my lease if a doctor states that this is a valid health concern.

    This is not a good reason to get out from your lease,because this is a commen situation for people live in apartment.If you just leave your landlord could keep your security depose.If you don’t pay the last month and breach the lease then the landlord could bring you to court and you have to prove your point and convent to the judge.

    I would suggest you look for the Clean Air Act in your state. You may have a cause if you can medically prove it is detrimental to your health and that living there would cause you harm. It is State by State, or consult a Lease Attorney for a free consultation. For example refer to link below:
